Terms of use and sale
This English version is provided for convenience; the French version prevails in case of difference.
1. Purpose
These terms govern the use of the Foldy service and the purchase of its paid plans. They apply as soon as you sign in; for purchases, they are accepted before each payment.
2. The service
Foldy lets the administrators of a Discord server, through a bot they add themselves, make backups (server configuration: roles, channels, permissions, emojis), archives (the same plus the history of messages the bot can read), read them, share them with chosen Discord accounts and restore a configuration. Foldy depends on Discord: some data may be unavailable (private channels, deleted messages, Discord limits).
3. Account
You sign in with a Discord account and must follow Discord's terms, including its minimum age. To buy a plan you must be an adult or have your legal guardian's consent. You can delete your account at any time from the “My account” page.
4. Your commitments as an administrator
- only install Foldy on servers you administer;
- inform members that Foldy is present and keep that information visible;
- never use Foldy to harass, expose or harm anyone, or to store illegal content;
- respect members' rights, including their right to refuse archiving.
- only make an archive public if you are entitled to, knowing any member can remove their messages; publishing a server template only shares its structure, never its members.
5. Server members' data
For the messages and information of a server's members, the administrator using Foldy is the controller and Foldy acts as processor (GDPR, Article 28), under the data processing agreement accepted at installation. Each member can see the archives they appear in and remove their data with the /foldy erase command. See the privacy policy.
6. Plans and prices
A free plan and paid plans (Starter, Pro, Ultimate) are offered as monthly subscriptions. Each plan's limits are described on the Plan page. The price is shown by Discord before purchase, in your currency and including the taxes that apply in your country. A price change only applies to new subscriptions.
7. Order and payment
Subscriptions are bought in the Foldy app store on Discord. Discord collects the payment and applies its own Paid Services Terms. The plan starts on the Foldy account linked to the same Discord account, a few seconds after purchase. The subscription renews automatically every month until cancelled. You can cancel at any time in Discord, under User Settings then Subscriptions: the plan stays active until the end of the paid period, then stops.
8. Changing plan
To change plan, subscribe to the new plan in Discord and cancel the old one. While two subscriptions are active, the better plan applies.
9. Right of withdrawal
At purchase, Discord asks you to agree that the service starts immediately and to acknowledge that you then lose your right of withdrawal. Refund requests are handled by Discord under its refund policy. If something goes wrong because of Foldy, write to contact@papery.my and we will help.
10. Legal guarantee and refunds
Foldy is a digital service covered by the legal guarantee of conformity. If the service is durably interrupted through our fault, the lost period is extended or refunded. Otherwise, a started period is not refunded.
11. Availability and liability
We do our best to keep Foldy running and your data safe, without being able to guarantee zero interruption. Nothing in these terms limits your consumer protection or our liability for gross negligence or personal injury.
12. Illegal content, suspension and termination
Illegal content can be reported to contact@papery.my. We handle reports promptly and inform the person concerned of any measure taken and its reasons, with the possibility to contest it. Serious breaches may lead to the suspension of an account or server; you are informed in that case.
13. Changes, complaints, law
You will be notified at least 30 days before any significant change to these terms. Contact us first at contact@papery.my; you may then refer to a consumer mediator. These terms are governed by French law; residents of another EU country keep the protection of their country's mandatory rules.
